Terms of Service

Last updated: November 2024

1. Acceptance of Terms

By accessing or using Escrow.international ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Escrow.international provides a decentralized escrow service that allows users to securely exchange cryptocurrency through smart contracts deployed on the BNB Smart Chain. The Service acts as a neutral intermediary by holding funds in a smart contract until the conditions of a transaction are met.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use this Service. By using the Service, you represent and warrant that you meet these requirements.

4. User Responsibilities

You agree to:

  • Provide accurate information when creating escrow transactions
  • Maintain the security of your wallet and private keys
  • Not use the Service for any illegal activities
  • Not attempt to exploit, hack, or manipulate the smart contracts
  • Comply with all applicable laws and regulations

5. Fees

The Service charges a fee of 1% per transaction. This fee is automatically deducted when an escrow is created and is non-refundable. Additional network fees (gas fees) may apply and are paid directly to the blockchain network.

6. Escrow Process

6.1 Creating an Escrow

The buyer creates an escrow by depositing tokens into the smart contract and specifying the seller's wallet address and expiration time.

6.2 Completing an Escrow

The buyer can release funds to the seller by confirming delivery. Once confirmed, the transaction is irreversible.

6.3 Expiration

If the buyer does not confirm delivery before the expiration time, the seller can claim the funds. This is to protect sellers from unresponsive buyers.

6.4 Refunds

The seller or contract owner can initiate a refund at any time before the escrow is completed. Refunds return the full amount (including the fee) to the buyer.

7. Risks

You acknowledge and accept the following risks:

  • Cryptocurrency values can be highly volatile
  • Blockchain transactions are irreversible
  • Smart contracts may contain bugs despite auditing
  • Loss of private keys results in permanent loss of funds
  • Network congestion may delay transactions
  • Regulatory changes may affect the Service

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCROW.INTERNATIONAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

10. Dispute Resolution

As a decentralized service, we do not mediate disputes between buyers and sellers. Users are encouraged to communicate clearly and only transact with parties they trust. The smart contract executes automatically based on its programmed conditions.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable international laws, without regard to conflicts of law principles.
